Liquidation Pallet Policy – Terms & Conditions
Liquidation Pallet Purchase Policy & Terms of Sale
Terms & Conditions,This policy governs the sale of all liquidation pallets, truckloads, and bulk merchandise on our site. By placing an order, you (“the Buyer”) agree to be bound by the following terms and conditions. Please read this document carefully before making a purchase, as it constitutes a legally binding agreement.
1. The “As-Is” Nature of All Merchandise
All products are sold in “as-is” condition. This is the fundamental principle of the liquidation industry. It means there are no guarantees, warranties, or promises regarding the condition, functionality, completeness, or resale value of any item.
- Source of Goods: Our pallets consist of customer returns, overstock, and shelf-pulled merchandise from major retailers and manufacturers.
- Variable Condition: You should expect a wide spectrum of item conditions within any given pallet, including brand new, open-box, used, non-functional, or incomplete items.
- No Testing: We do not individually test or inspect every item within a sealed pallet. The potential for a mix of conditions is what allows us to offer these goods at a significant discount to retail value.
Your purchase is an acknowledgment and acceptance of this inherent risk.
2. All Sales Are Final
Consistent with the “as-is” nature of the goods, all sales are final. We do not accept returns, offer refunds, or provide exchanges for any reason. This policy is strictly enforced and is non-negotiable.
3. Product Manifests and Listings
We provide information to help you make an informed decision, but this information is provided on a best-effort basis.
- Manifests: When a manifest is provided, it is a list of the items believed to be on the pallet based on the source documentation. Manifests are for informational purposes only and are not guaranteed to be 100% accurate. Item counts, models, or conditions may vary.
- Photos: All photos are representative of the type of merchandise or the specific pallet you are purchasing. However, we cannot guarantee that every single item visible in a photo will be present in your exact pallet.
- Estimated Retail Value (ERV): Any stated ERV is an approximation based on the original MSRP of the items. It is not a guarantee of what you will be able to resell the items for.
4. Buyer’s Due Diligence and Responsibility
The responsibility for due diligence rests entirely with the Buyer. By purchasing, you confirm that:
- You have experience with or a full understanding of the liquidation market.
- You have researched the product category and are aware of the potential risks and rewards.
- You are purchasing for your own account and risk.
5. Freight Damage and Inspection
While the merchandise itself is sold as-is, we ensure it is properly packaged for transit. Damage caused by the freight carrier is handled separately.
- Your Obligation: You must inspect the pallet for shipping damage before signing the Bill of Lading (BOL) from the carrier.
- Notating Damage: If any damage to the pallet, shrink wrap, or structure is visible, you must write “SUBJECT TO INSPECTION” or a detailed description of the damage on the BOL.
- Failure to Note: If you sign for the delivery without noting damage, you are accepting the shipment in good condition, and no freight claim can be made.
Please refer to our full Shipping Policy for detailed instructions on this process.
6. Prohibited Resale Channels
We do not restrict where you can resell your merchandise. However, you are strictly prohibited from listing any items from our pallets on any platform or marketplace where we or our source partners actively sell new goods. This includes but is not limited to selling items as “new” when they are customer returns, or misrepresenting the item’s origin or condition.
7. Limitation of Liability
Our liability is limited to the purchase price of the pallet. We shall not be liable for any indirect, special, incidental, or consequential damages, including but not limited to loss of profit or business opportunity, arising from the purchase or use of the merchandise.
8. Agreement to Terms
By placing an order and completing payment, you (“the Buyer”) affirm that you have read, understood, and agreed to all terms and conditions outlined in this Liquidation Pallet Policy, our Refund & Return Policy, and our Shipping Policy. These policies are incorporated by reference into your sales agreement.
